Terms of Service

Read Before You Ride

Electric scooters can travel at speed and carry real risk. By purchasing or using a Metro America product, you confirm you're at least 18 years old (or the age of majority where you live), and you agree to follow all local laws on where, how, and by whom e-scooters may be ridden — including helmet, licensing, and age requirements.

You ride at your own risk. Metro America is not responsible for injuries, accidents, or damage resulting from misuse, modification, or riding in violation of local law.

Acceptance of these terms

These Terms of Service ("Terms") govern your access to and use of the Metro America website, the Metro+ mobile app, and any products or services we offer (together, the "Services"). By browsing our site, creating an account, using the Metro+ app, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase from Metro America or create a Metro+ account. By using the Services, you represent that you meet this requirement and that all information you provide is accurate and current.

Products, pricing & availability

  • Product descriptions, images, and specifications (including range, top speed, charge time, and weight) are provided for general informational purposes. Real-world performance varies based on rider weight, terrain, temperature, and riding style.
  • Prices are listed in USD and may change at any time without notice. We do our best to ensure pricing accuracy, but errors may occasionally occur; if a pricing error is found, we may cancel and refund the affected order.
  • Colors, finishes, and accessories shown may vary slightly from the product received, and availability of any model, color, or accessory is not guaranteed until your order is confirmed.

Orders & payment

  • By placing an order, you represent that you are authorized to use the payment method provided and authorize us to charge the full order amount, including applicable taxes and shipping fees.
  • We reserve the right to refuse, limit, or cancel any order for any reason, including suspected fraud, pricing errors, or inventory issues. If we cancel an order after payment, you'll receive a full refund.
  • An order confirmation email does not guarantee acceptance of your order — it confirms that we've received it.

Shipping & delivery

Orders ship from our New York warehouse via UPS. Estimated delivery times are provided for convenience and are not guaranteed; delays caused by the carrier, weather, customs, or other events outside our control are not our responsibility. Risk of loss and title for products pass to you upon delivery to the shipping carrier, though we'll work with you to resolve issues with lost or damaged shipments.

Returns, refunds & warranty

Returns and refunds are governed by our Refund Policy, which allows untouched, unused returns within 14 days of delivery. Scooters purchased within the last year are covered by our 1-year parts warranty against manufacturing defects, with free replacement parts and shipping. Metro One, our optional maintenance plan, provides additional repair and service coverage. Warranty coverage does not extend to damage caused by accidents, misuse, water exposure beyond rated limits, unauthorized repairs, or modifications.

Metro+ app & connected services

The Metro+ app provides locking, navigation, and ride-tracking features for compatible scooters. Use of the app requires a compatible device, an account, and an internet connection. We may add, modify, or discontinue app features at any time. We are not responsible for app downtime, connectivity issues, or third-party map or location service outages that affect app functionality. Your use of the app is also subject to its in-app terms and our Privacy Policy.

Rider responsibility & safety

  • You are solely responsible for operating your Metro scooter safely, legally, and in accordance with the included user manual.
  • Always wear a helmet and appropriate protective gear, follow traffic laws, and only ride where e-scooters are permitted under local regulations.
  • Do not ride while impaired, distracted, carrying passengers (unless your model is rated for it), or in conditions outside the product's rated specifications (e.g., heavy rain, extreme heat or cold, or terrain beyond its design).
  • Riding an electric scooter carries inherent risks of injury. By using a Metro America product, you voluntarily assume these risks.

Prohibited uses & intellectual property

You may not use the Services for any unlawful purpose, attempt to disassemble or tamper with battery or safety systems in ways that void certifications, resell Metro products as new without authorization, or copy, scrape, or republish content from our site or app. All trademarks, logos, product designs, photography, and site content are the property of Metro America (Metro Rides) or its licensors and may not be used without our prior written permission.

Disclaimers & limitation of liability

Except for the express warranty described in our warranty terms, the Services and products are provided "as is" and "as available" without warranties of any kind, whether express or implied. To the fullest extent permitted by law, Metro America will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of use, data, or profits, arising from your use of the Services or products. Our total liability for any claim related to the Services or products is limited to the amount you paid for the relevant product.

Indemnification

You agree to indemnify and hold Metro America, its officers, employees, and affiliates harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, or your violation of any law or third-party right, including while riding a Metro scooter.

Governing law & changes to these terms

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any disputes arising under these Terms will be resolved in the courts located in that jurisdiction, unless otherwise required by applicable consumer protection law. We may update these Terms from time to time; the "Effective" date above reflects the latest revision. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
